734.5 Ordinance of 25 November 2015 on Electromagnetic Compatibility (OEMC)

Art. 15

1 Les appareils mis à disposition sur le marché et pouvant être incorporés dans une installation fixe sont soumis à toutes les dispositions applicables concernant les appareils contenues dans la présente ordonnance.

2 Les appareils prévus pour être incorporés dans une installation fixe particulière et qui n’ont pas été mis à disposition sur le marché par ailleurs ne sont pas soumis aux art. 4, 8 à 12, 13, al. 1, et 14.

3 La documentation qui accompagne un appareil visé à l’al. 2 doit contenir les indications suivantes, en plus de celles qui sont demandées à l’art. 13, al. 3 à 6:19

a.
la désignation de l’installation fixe dans laquelle il doit être incorporé et les caractéristiques de cette dernière en termes de compatibilité électromagnétique;
b.
les dispositions qui doivent être prises au moment de l’incorporation de l’appareil dans ladite installation pour éviter que sa conformité n’en soit affectée.

Art. 15

1 Apparatus that is made available on the market and which may be incorporated in fixed installations is subject to all the regulations applicable to apparatus in this Ordinance.

2 Apparatus intended for incorporation into a fixed installation but which are otherwise not made available on the market is exempt from Articles 4, 8–12, 13 paragraph 1 and 14.

3 In addition to the information mentioned in Article 13 paragraphs 3–6, the documentation accompanying apparatus referred to in paragraph 2 must contain the following information:20

a.
identification of the fixed installation into which it is to be incorporated and its electromagnetic compatibility characteristics;
b.
the precautions to be taken for the incorporation of the apparatus into the installation in order not to compromise the conformity of that installation.
