Art. 230bis Mise en danger par des organismes génétiquement modifiés ou pathogènes

1 Celui qui, intentionnellement, aura disséminé dans l’environnement des organismes génétiquement modifiés ou pathogènes, aura perturbé l’exploitation d’une installation destinée à la recherche sur ces organismes, à leur conservation ou à leur production, ou aura gêné leur transport, sera puni d’une peine privative de liberté de un à dix ans, s’il savait ou devait savoir que par ses actes:

a.
il mettait en danger la vie et l’intégrité corporelle des personnes ou
b.
il mettait gravement en danger la composition naturelle des populations animales et végétales ou leur habitat.

2 La peine sera une peine privative de liberté de trois ans au plus ou une peine pécuniaire si l’auteur a agi par négligence.

Art. 230bis Causing danger by means of genetically modified or pathogenic organisms

1 Any person who wilfully releases genetically modified or pathogenic organisms or the disrupts the operation of a facility for the research into, or the safeguarding, production or transport of such organisms shall be liable to a custodial sentence not exceeding ten years, provided he knows or must assume that through his acts:

a.
he will endanger the life and limb of people; or
b.
the natural composition of communities of animals and plants or their habitats will be seriously endangered.

2 If the offender acts through negligence, he shall be liable to a custodial sentence not exceeding three years or to a monetary penalty.
