272 Swiss Civil Procedure Code of 19 December 2008 (Civil Procedure Code, CPC)
Art. 117 Droit
Une personne a droit à l’assistance judiciaire aux conditions suivantes:
- a.
- elle ne dispose pas de ressources suffisantes;
- b.
- sa cause ne paraît pas dépourvue de toute chance de succès.
Art. 118 Extent
1 Legal aid comprises:
- a.
- an exemption from the obligation to pay advances and provide security;
- b.
- an exemption from court costs;
- c.
- the appointment by the court of a legal agent under the legal aid system if this is necessary to protect the rights of the party concerned, and in particular if the opposing party is represented by a legal agent; the legal agent under the legal aid system may be appointed prior to the court hearing in order to prepare the proceedings.
2 Legal aid may be granted for all or part of the case.
3 The grant of legal aid does not relieve the party concerned from paying party costs to the opposing party.
