Art. 110 A. Subrogation

Le tiers qui paie le créancier est légalement subrogé, jusqu’à due concurrence, aux droits de ce dernier:

1.: lorsqu’il dégrève une chose mise en gage pour la dette d’autrui et qu’il possède sur cette chose un droit de propriété ou un autre droit réel;
2.: lorsque le créancier a été prévenu par le débiteur que le tiers qui le paie doit prendre sa place.

Art. 110 A. Subrogation

A third party who satisfies the creditor is by operation of law subrogated to his rights:

1.: if he redeems an object given in pledge for the debt of another and he owns said object or has a limited right in rem in it;
2.: if the debtor notifies the creditor that the third party who is paying is to take the creditor’s place.
