Art. 25 Contraventions

1 A person shall be liable to detention or a fine not exceeding 50 000 Swiss francs for wilfully or negligently, without an offence having been committed as specified in Article 24:

a.
contravening the requirements concerning the independence of participants (Art. 6);
b.
failing to comply with the duties of a licensee or conditions attached to a licence or the duties of a project manager, or contravening the notification requirement (Arts. 9, 10, 13, 15 and 16);
c.
carrying out a research project although it has been prohibited by the Federal Office, or failing to fulfil conditions attached thereto (Art. 14);
d.
failing to comply with the duty of cooperation (Art. 20);
e.
contravening an implementing regulation, infringement of which has been declared by the Federal Council to carry a penalty, or contravening an order addressed to that person with reference being made to the penalty provided for in this Article.

2 Attempt and complicity shall also be punishable.

3 A contravention and the penalty for a contravention are subject to a five-year prescriptive period.

4 In particularly trivial cases, charging, prosecution and punishment may be waived.
