Art. 23a Passing on of information

The custodian designated by a company limited by shares under Article 697i paragraph 4 or Article 697j paragraph 3 of the Code of Obligations42 must ensure that on request downstream custodians pass on the following information:

a.
the first name and surname or business name and address of the shareholder; and
b.
the first name and surname and address of the beneficial owner.

Art. 23a Trasmissione di informazioni

L’ente di custodia designato da una società anonima secondo l’articolo 697i capoverso 4 o l’articolo 697j capoverso 3 del Codice delle obbligazioni38 deve assicurare che gli enti di custodia che, a catena, lo seguono, trasmettano su richiesta le seguenti informazioni:

a.
il nome e il cognome o la ditta nonché l’indirizzo dell’azionista; e
b.
il nome e il cognome o la ditta nonché l’indirizzo dell’avente economicamente diritto.
