Art. 47 Audit of annual financial statements

1 Any person who wilfully:

a.100
fails to have the annual financial statements required by the financial market acts audited by a licensed audit company or to have an audit carried out that has been ordered by FINMA or a supervisory organisation;
b.
fails to fulfil his or her obligations vis-à-vis the audit company or the agent,
is liable to a custodial sentence of up to three years or to a monetary penalty.

Art. 44

1 Chiunque, intenzionalmente, esercita senza autorizzazione, riconoscimento, abilitazione, registrazione o affiliazione a un organismo di autodisciplina ai sensi dell’articolo 24 capoverso 1 della legge del 10 ottobre 199792 sul riciclaggio di denaro un’attività che è soggetta ad autorizzazione, riconoscimento, abilitazione, registrazione conformemente alle leggi sui mercati finanziari o che presuppone l’affiliazione a un organismo di autodisciplina, è punito con una pena detentiva sino a tre anni o con una pena pecuniaria.93
