Art. 82 Control of units and unit certificates

(Arts. 11 and 73 para. 1 CISA)

1 The custodian bank shall record the issue and redemption of units, including fractions thereof, on a continuous basis. It shall record the following details:

a.
the date of issue or redemption;
b.
the number of units issued or redeemed;
c.
the gross amount paid by the investor or net payment made to the investor;
d.
the fees and incidental costs in relation to the issue or redemption;
e.
the amount credited or debited to the collective investment scheme;
f.
the net asset value of the unit.

2 In the case of registered units, the identity of the investor must also be recorded.

3 The custodian bank shall record the issue and redemption of unit certificates separately.

Art. 82 Controllo delle quote e dei certificati

(art. 11 e 73 cpv. 1 LICol)

1 La banca depositaria registra l’emissione e il riscatto di quote comprese le frazioni. Al riguardo, rileva le informazioni seguenti:

a.
la data dell’emissione o del riscatto;
b.
il numero delle quote emesse o riscattate;
c.
il versamento lordo dell’investitore o il versamento netto all’investitore;
d.
le rimunerazioni e le spese accessorie per l’emissione o il riscatto;
e.
la somma accreditata o addebitata all’investimento di capitale;
f.
il valore netto di inventario della quota.

2 Se le quote sono nominative, l’identità dell’investitore deve essere registrata separatamente.

3 La banca depositaria registra separatamente le emissioni e il riscatto di certificati di quote.
