813.12 Ordinanza del 18 maggio 2005 concernente l'immissione sul mercato e l'utilizzazione di biocidi (Ordinanza sui biocidi, OBioc)

Art. 36 Packaging

1 Biocidal products and active substances for use in biocidal products must be packaged in accordance with Article 8 of the ChemO170 mutatis mutandis. Where the ChemO refers:171

a.
to the manufacturer, this shall be understood for the purposes of this Ordinance as the authorisation holder;
b.
to dangerous substances and preparations, this shall be understood for the purposes of this Ordinance as all biocidal products and active substances for use in biocidal products.

2 Where appropriate, the information included in the ruling referred to in Article 20 shall be taken into account.

3 Biocidal products which may be mistaken for foodstuffs within the meaning of the Foodstuffs Act of 20 June 2014172 or for animal feedstuffs within the meaning of Article 3 paragraph 1 of the Feedstuffs Ordinance of 26 May 1999173 must be packaged to minimise the likelihood of such a mistake being made.174

Art. 36 Imballaggio

1 Per l’imballaggio dei biocidi e dei principi attivi destinati a essere utilizzati in biocidi si applica per analogia l’articolo 8 OPChim167. Laddove:168

a.
nell’OPChim si parla di fabbricante, nella presente ordinanza s’intende il titolare dell’omologazione;
b.
nell’OPChim si parla di sostanze e preparati pericolosi, nella presente ordinanza s’intendono tutti i biocidi e i principi attivi destinati a essere utilizzati in biocidi.

2 Se del caso occorre tener conto dei dati della decisione di cui all’articolo 20.

3 I biocidi che possono essere confusi con le derrate alimentari ai sensi della legge del 9 ottobre 1992169 sulle derrate alimentari o con alimenti per animali ai sensi dell’articolo 3 capoverso 1 dell’ordinanza del 26 maggio 1999170 sugli alimenti per animali devono essere imballati in modo tale che la probabilità di confusione sia ridotta al minimo.171
