Art. 53 An ETS installation operator’s obligation to report changes

1 ETS participants shall inform the competent authority without delay in accordance with Annex 14 about:

a.
changes that could affect the emission allowances to be allocated free of charge;
b.
changes in contact information.
2 Aircraft operators which no longer perform flights in accordance with Annex 13 must report this to the competent authority under Annex 14 no later than three months after cessation of the relevant flight activities.

3 Installation operators that carry on an activity in accordance with Annex 6 and that are exempt from the requirement to participate in the ETS shall notify the FOEN immediately:

a.
if the annual greenhouse gas emissions from the installations amount to 25 000 tonnes of CO2eq or more;
b.
of any changes to their contact details.170

Art. 54 Compiti dei Cantoni

1 I Cantoni verificano se i gestori di impianti adempiono ai loro obblighi di notifica di cui agli articoli 40 capoverso 2 e 53 capoversi 1 e 3 e se le informazioni trasmesse sono complete e comprensibili.172

2 L’UFAM mette a disposizione dei Cantoni le informazioni che servono a tale scopo.

3 Se constata che i requisiti sanciti nella presente ordinanza non sono adempiuti, il Cantone informa senza indugio l’UFAM.

4 L’UFAM può coinvolgere i Cantoni per chiarire domande a cui è necessario rispondere per l’esecuzione delle disposizioni relative al SSQE.173
