Art. 35 Offences against the prohibition of anti-personnel mines

1 Any person who wilfully commits any of the following acts without being able to claim an exemption under Article 8 paragraph 2 is liable to a custodial sentence not exceeding ten years or to a monetary penalty:47

a.
the development, manufacture, brokerage, acquisition, surrender to another, import, export, transit, stockpiling, or any other form of possession of anti-personnel mines;
b.
incitement to commit any of the acts listed under letter a; or
c.
assisting in the commission of an act listed under letter a.

2 A custodial sentence may be combined with a monetary penalty.48

3 If the act is committed through negligence, the penalty is a custodial sentence not exceeding one year or a monetary penalty.49

Art. 35 Inosservanza del divieto di mine antiuomo

1 Chiunque, intenzionalmente e senza poter far valere una deroga secondo l’articolo 8 capoverso 2:

a.
sviluppa, fabbrica, procura, acquista, fornisce ad altri52, importa, esporta, fa transitare, deposita mine antiuomo o ne dispone in altro modo;
b.
induce altri53 a commettere una delle infrazioni definite nella lettera a, o
c.
favorisce una delle infrazioni definite nella lettera a,

è punito con una pena detentiva sino a dieci anni o con una pena pecuniaria.54

2 Con la pena detentiva può essere cumulata una pena pecuniaria.55

3 Se l’autore ha agito per negligenza, la pena è una pena detentiva sino a un anno o una pena pecuniaria.56
