Art. 27 Notification of legislation and rulings

1 The cantons shall notify the FOEN, the FOC or FEDRO of their legislation on nature protection, cultural heritage protection and monument preservation.70

2 The competent authorities shall notify the FOEN of any rulings on the following:

a.
exceptional approvals relating to the species protection provisions (Art. 22 para. 1 and 3 NCHA; Art. 20 para. 3);
b.
removal of riparian vegetation (Art. 22 para. 2 and 3 NCHA);
c.
declaratory rulings on biotopes and species protection (Art. 14 para. 4);
d.
restitution rulings (Art. 24e NCHA);
e.71
rulings on relating to buildings, installations and soil degradation in biotopes of national importance (Art. 18a NCHA) or in mire landscapes (Art. 23b NCHA).
f.72
approvals of land use plans (Art. 26 Spatial Planning Act of 22 June 197973) if landscapes, natural monuments, biotopes or mire landscapes of national importance are damaged.

3 If the FCNC, the FCMP, the FOEN, the FOC or FEDRO have collaborated on a project as specified in Article 2, the competent authority shall notify them of the relevant decision on request.

Art. 27 Comunicazione di testi legali e decisioni

1 I Cantoni comunicano all’UFAM, all’UFC o all’USTRA i loro atti legislativi riguardanti la protezione della natura, la protezione del paesaggio e la conservazione dei monumenti storici.72

2 Le autorità competenti comunicano all’UFAM le seguenti decisioni:

a.
eccezioni relative alle disposizioni della protezione delle specie (art. 22 cpv. 1 e 3 LPN; art. 20 cpv. 3);
b.
rimozione della vegetazione ripuale (art. 22 cpv. 2 e 3 LPN);
c.
decisioni d’accertamento nell’ambito della protezione dei biotopi e delle specie (art. 14 cpv. 4);
d.
decisioni riguardanti il ripristino (art. 24e LPN);
e.73
decisioni riguardanti le costruzioni, gli impianti e le modifiche della configurazione del terreno nei biotopi d’importanza nazionale (art. 18a LPN) o nelle zone palustri (art. 23b LPN);
f.74
approvazioni dei piani d’utilizzazione (art. 26 della L del 22 giu. 197975 sulla pianificazione del territorio), se sono pregiudicati paesaggi, monumenti naturali, biotopi o zone palustri d’importanza nazionale.

3 Se la CFNP, la CFMS, l’UFAM, l’UFC e l’USTRA hanno collaborato ad un progetto giusta l’articolo 2, l’autorità competente comunica loro, su domanda, le relative decisioni.
