Art. 185bis Enforced disappearance

1 Any person who with the intention of removing a person from the protection of the law for a prolonged period of time:

a.
on behalf of or with the acquiescence of a State or political organisation, deprives that person of their liberty, and thereafter refuses to give information as to their fate or whereabouts; or
b.
on behalf of or with the acquiescence of a State or political organisation or in violation of a legal duty refuses to give information as to the fate or whereabouts of the person concerned.

shall be liable to a custodial sentence of not less than one year.

2 Any person who commits the offence abroad is also liable to the foregoing penalty provided they are now in Switzerland and are not extradited. Article 7 paragraphs 4 and 5 apply.

Art. 185bis Sparizione forzata

1 È punito con una pena detentiva non inferiore ad un anno chiunque, nell’intento di sottrarre una persona per un prolungato periodo di tempo alla protezione della legge:

a.
priva la persona della libertà su mandato o con l’approvazione di uno Stato o di un’organizzazione politica, negando in seguito la fornitura di informazioni sulla sorte di tale persona o sul luogo in cui questa si trova; o
b.
si rifiuta di fornire informazioni sulla sorte di tale persona o sul luogo in cui questa si trova, su mandato di uno Stato o di un’organizzazione politica oppure in violazione di un obbligo legale.

2 È punibile anche chi commette il reato all’estero, si trova in Svizzera e non è estradato. È applicabile l’articolo 7 capoversi 4 e 5.

231 Introdotto dall’all. 2 n. 1 del DF del 18 dic. 2015 che approva e traspone nel diritto svizzero la Convenzione internazionale per la protezione di tutte le persone dalla sparizione forzata, in vigore dal 1° gen. 2017 (RU 2016 4687; FF 2014 417).
