Art. 23 Inspection of the files

1 Prior to the entry of the design in the Register and during the period of deferment of publication, the dossier may be inspected by:

a.
the applicant and his or her representative;
b.
persons who prove that the applicant alleges that they have infringed the applicant’s right to the filed design or has warned them of such an infringement;
c.
other persons with the express consent of the applicant or his or her representative.

2 The persons named in paragraph 1 may also inspect the files relating to applications for registration that have been withdrawn or rejected, or which the IPI has dismissed.

3 Anyone may inspect the dossier after the design has been entered in the Register, provided that the publication has not been deferred.

4 The IPI shall make a decision regarding the inspection of separately filed official documents of evidence in accordance with Article 22 paragraph 2 following consultation with the right holder.

5 On request, the files to be inspected shall be issued in the form of copies.33

Art. 23 Consultazione degli atti

1 Prima dell’iscrizione del design nel registro e durante il periodo del differimento della pubblicazione, il fascicolo può essere consultato:

a.
dal depositante e dal suo rappresentante;
b.
dalle persone che comprovano che il depositante rimprovera loro di ledere il diritto sul design depositato o le mette in guardia da una tale lesione;
c.
da altre persone con il consenso esplicito del depositante o del suo rappresentante.

2 Le persone menzionate nel capoverso 1 possono consultare anche gli atti delle domande di registrazione che sono state ritirate o respinte oppure sulle quali l’IPI non è entrato nel merito.

3 Dopo l’iscrizione del design nel registro, sempre che la pubblicazione non sia stata differita, chiunque può consultare il fascicolo.

4 Circa la consultazione dei documenti di prova conservati separatamente giusta l’articolo 22 capoverso 2 decide l’IPI dopo aver sentito il titolare del diritto.

5 Su domanda, la consultazione è autorizzata mediante la consegna di copie.35
