Art. 15 Famous trade marks

1 The proprietor of a famous trade mark may prohibit others from using his trade mark for any type of goods or services if such use threatens the distinctiveness of the trade mark or exploits or damages its reputation.

2 Rights acquired before the trade mark became famous remain unaffected.

1 Il titolare di un marchio famoso può vietarne a terzi l’uso per tutti i prodotti o servizi se un tale uso minaccia il carattere distintivo del marchio o ne sfrutta o mette in pericolo la rinomanza.

2 Sono fatti salvi i diritti acquisiti prima che il marchio sia divenuto famoso.
