Art. 31 Unknown authorship

1 Where the author of a work is unknown, protection for that work expires 70 years after it has been published or, if it has been published in instalments, 70 years after the final instalment.

2 If the identity of the person29 who has created the work becomes publicly known before the expiry of the aforementioned term, protection for the work expires:

a.
in the case of computer programs, 50 years after the death of the author30;
b.
in the case of all other works, 70 years after the death of the author31.

Art. 31 Autore ignoto

1 Se l’autore è ignoto, la protezione dell’opera si estingue 70 anni dopo la sua pubblicazione o, se essa è stata pubblicata a dispense, 70 anni dopo la pubblicazione dell’ultima dispensa.

2 Se l’identità dell’autore è divenuta di pubblica ragione prima della scadenza del termine precitato, la protezione dell’opera si estingue:

a.
50 anni dopo la morte dell’autore per i programmi per computer;30
b.
70 anni dopo la morte dell’autore per ogni altro genere di opere.31
