Art. 29 general

1 A work is protected by copyright as soon as it is created, irrespective of whether it has been fixed on a physical medium.

2 Protection expires:

a.
in the case of computer programs, 50 years after the death of the author;
abis.23 50 years after production for photographic depictions and depictions of three-dimensional objects produced by a process similar to that of photography if the depictions do not have individual character;
b.
in the case of all other works, 70 years after the death of the author.

3 Where it is has to be assumed that the author has been dead for more than 50 or 70 years24 respectively, protection no longer applies.

4 Articles 30 and 31 do not apply to photographic depictions and depictions of three-dimensional objects produced by a process similar to that of photography if the depictions do not have individual character.25

Art. 29 In generale

1 Un’opera, fissa o meno, è protetta dal diritto d’autore dal momento in cui è creata.

2 La protezione si estingue:

a.
50 anni dopo la morte dell’autore per i programmi per computer;
abis.24
50 anni dopo la produzione per le rappresentazioni fotografiche e le rappresentazioni di oggetti tridimensionali ottenute con procedimenti analoghi a quello della fotografia che non presentano un carattere originale;
b.
70 anni dopo la morte dell’autore per ogni altro genere di opere.

3 La protezione si estingue quando deve presumersi che l’autore è deceduto da più di 50, rispettivamente 70 anni.25

4 Alle rappresentazioni fotografiche e alle rappresentazioni di oggetti tridimensionali ottenute con procedimenti analoghi a quello della fotografia che non presentano un carattere originale non si applicano gli articoli 30 e 31.26
