Art. 799 1. Registration

1 Subject to exceptions provided by law, a mortgage is created by its recording in the land register.

2 A legal transaction creating a mortgage is valid only if done as a public deed.637

Art. 798a 3. Fondi agricoli

La costituzione in pegno dei fondi agricoli è inoltre retta dalla legge federale del 4 ottobre 1991622 sul diritto fondiario rurale.
