Art. 5 Official Documents

¹An official document is any information:

a.: which has been recorded, regardless of the medium;
b.: retained by the authority which issued the same or to which it has been communicated; and
c.: which concerns the execution of a public function.

² Documents which have been produced by means of a simple computerised process from recorded information which meets the requirements of paragraph 1 letters a, b and c above are deemed to be official documents.

³ Not deemed to be official documents are any documents which:

a.: are used by an authority in a commercial capacity;
b.: have not been issued; or
c.: are intended for personal use.

Art. 5 Documenti ufficiali

¹ Per documento ufficiale si intende ogni informazione:

a.: registrata su un supporto qualsiasi;
b.: in possesso dell’autorità da cui proviene o a cui è stata comunicata; e
c.: concernente l’adempimento di un compito pubblico.

² Sono considerati ufficiali anche i documenti che possono essere allestiti mediante un trattamento informatico semplice sulla base di informazioni registrate che soddisfano le condizioni di cui al capoverso 1 lettere b e c.

³ Non sono considerati ufficiali i documenti:

a.: utilizzati da un’autorità per scopi commerciali;
b.: la cui elaborazione non è terminata; o
c.: destinati all’uso personale.
