Art. 23 Changes and new findings

1 The applicant or licence holder must inform the FOEN without delay about:

a.
new findings and observations that might require a reassessment of the risk;
b.
changes to the experimental conditions and the monitoring plan.

2 The applicant or licence holder must examine the measures listed in the licence and, if the observance of the requirements in accordance with Articles 7–9, 12 and 13 or 15 and 16 is directly and seriously endangered, take the additional measures required.

3 The FOEN shall inform the specialist agencies concerned (Art. 37 para. 1).

Art. 23 Modifications et éléments nouveaux

1 Le requérant et le titulaire d’une autorisation doivent notifier immédiatement à l’OFEV:

a.
tout élément nouveau et toute observation qui pourraient nécessiter une réévaluation du risque;
b.
toute modification des conditions expérimentales et du plan de surveillance.

2 Le titulaire d’une autorisation doit vérifier les mesures indiquées dans l’autorisation et prendre les mesures supplémentaires qui s’imposent si le respect des exigences au sens des art. 7 à 9, 12 et 13 ou 15 et 16 est compromis de manière imminente et grave.

3 L’OFEV informe les services spécialisés concernés (art. 37, al. 1).
