Art. 2 Scope

1 The Act applies to all activities, installations, events and situations that may involve an ionizing radiation hazard, and in particular to:

a.
the handling of radioactive substances and of installations, equipment and articles containing radioactive substances or capable of emitting ionizing radiation;
b.
events that may lead to an increase in environmental radioactivity.

2 The term «handling» covers extraction, manufacturing, processing, distribution, installation, use, storage, transport, disposal, import, export and transit, and any other form of transfer to a third party.4

3 Articles 28–38 are not applicable to activities requiring a licence under the Nuclear Energy Act of 21 March 20035.6

Art. 2 Champ d’application

1 La présente loi s’applique à toutes les activités, à toutes les installations, à tous les événements et à toutes les situations qui peuvent présenter un danger lié à des rayonnements ionisants, notamment:

a.
à la manipulation de substances radioactives ainsi que d’appareils, installations et objets contenant des substances radioactives ou pouvant émettre des rayonnements ionisants;
b.
aux événements qui peuvent provoquer une augmentation de la radioactivité de l’environnement.

2 Par manipulation, on entend la production, la fabrication, le traitement, la commercialisation, le montage, l’utilisation, l’entreposage, le transport, l’évacuation, l’importation, l’exportation, le transit ainsi que toute autre forme de remise à un tiers.4

3 Les art. 28 à 38 ne s’appliquent pas aux activités soumises à autorisation en vertu de la loi du 21 mars 2003 sur l’énergie nucléaire5.6
