Art. 48 Transitional provisions

1 Research projects as defined in Chapter 2 which were granted authorisation before 1 January 2014 are considered to be Category B research projects.

2 On request, the authority which authorised the research project before 1 January 2014 may assign the research project to Category A. In this case, the liability, coverage and notification requirements are governed by the new law.

3 The ethics committee shall make the decision specified in paragraph 2 according to the simplified procedure specified in Article 6 of the HRA Organisation Ordinance of 20 September 201311.

4 The provisions of this Ordinance are applicable:

a.
to the assessment of significant changes to research projects as specified in Chapter 2;
b.
to notifications concerning research projects as specified in Chapters 3–5.

5 The responsible ethics committee shall make a decision on applications concerning research projects not subject to authorisation under existing law, submitted in accordance with Article 67 paragraph 2 HRA, within six months after acknowledgement of receipt of the formally correct application documents.

Art. 48 Dispositions transitoires

1 Les projets de recherche visés au chapitre 2 qui ont été autorisés avant le 1er janvier 2014 sont réputés être des projets de recherche de catégorie B.

2 L’autorité qui a autorisé un projet de recherche avant le 1er janvier 2014 peut classer un projet de recherche dans la catégorie A sur demande. En pareil cas, les obligations en matière de responsabilité, de garantie et d’annonces sont régies par le nouveau droit.

3 La commission d’éthique rend sa décision selon l’al. 2 en procédure simplifiée selon l’art. 6 de l’ordonnance d’organisation concernant la LRH du 20 septembre 201311.

4 Les dispositions de la présente ordonnance sont applicables:

a.
à l’examen des modifications essentielles apportées aux projets de recherche visés au chapitre 2;
b.
aux annonces relatives aux projets de recherche visés aux chapitres 3 à 5.

5 La commission d’éthique compétente rend une décision sur la demande d’autorisation d’un projet de recherche non assujetti à autorisation selon l’ancien droit au sens de l’art. 67, al. 2, LRH dans les six mois à compter de la confirmation de réception du dossier conforme aux exigences formelles.
