Art. 12 Exemptions from liability

Any person who proves that:

a.
the damage is only slight and temporary; and
b.
the extent of the damage is no greater than would be expected in the current state of scientific knowledge

shall be exempt from liability under Article 19 paragraph 1 HRA.

Art. 12 Exceptions à la responsabilité

Est libéré de la responsabilité au sens de l’art. 19, al. 1, LRH celui qui prouve que le dommage:

a.
n’a que des effets minimaux sur la santé et est temporaire, et
b.
ne dépasse pas l’ampleur qui est à prévoir en fonction de l’état de la science.
