732.1 Loi du 21 mars 2003 sur l'énergie nucléaire (LENu)

Art. 80 Obligation to pay additional contributions

1 In the event that the payments by a fund in favour of a beneficiary should exceed its entitlement, the beneficiary shall repay the difference to the fund, together with interest at normal market rates.

2 If the beneficiary is unable to effect repayment within a period specified by the Federal Council, the other contributing parties and beneficiaries of the fund concerned shall cover the difference through additional payments in proportion to their contributions.

3 An obligation to pay additional contributions shall also apply:

a.
in the case of Article 78 paragraph 4, if the contributions that have become the property of the fund should not suffice to cover the decommissioning or disposal costs;
b.
in the case of Article 79 paragraph 3, if the party responsible for disposal fails to repay the difference to the fund.

4 In the event that additional payments to cover shortages of funds should be deemed unreasonable by the parties concerned, the Federal Assembly shall decide whether, and to what extent, the Confederation shall contribute towards the uncovered costs.

Art. 79 Prestations des fonds

1 Si la créance d’un cotisant ne couvre pas les coûts, celui-ci s’acquitte de la somme manquante.

2 Si le cotisant prouve qu’il n’est pas en mesure de verser cette somme, le fonds de désaffectation ou le fonds d’évacuation des déchets couvre le solde des coûts en y consacrant l’ensemble des moyens disponibles. Il en va de même dans le cas prévu à l’art. 78, al. 4.

3 Le fonds d’évacuation des déchets couvre avec les cotisations les frais d’évacuation des déchets radioactifs que la Confédération doit assumer en vertu de l’art. 33, al. 1, let. b. Si les cotisations ne suffisent pas, l’ensemble des moyens disponibles du fonds y sont consacrés.
