Art. 28 Licence

1 The request for registration of a licence must be made by the right holder or by the licensee.

2 It shall include:

a.
an express declaration by the right holder or another satisfactory document showing that the right holder authorises the licensee to use the design;
b.
the surname and first name or the company name as well as the address of the licensee;
c.
the request that the licence be registered as an exclusive licence where applicable;
d.
in the case of a partial licence, an indication of the licensed rights where applicable.

3 For the registration of a sub-licence, paragraphs 1 and 2 apply by analogy. In addition, it must be proven that the licensee is authorised to grant sub-licences.

4 If an exclusive licence is entered in the Register, no other licenses that are incompatible with the exclusive license will be entered in the Register for the same design.42

Art. 28 Licence

1 Il incombe au titulaire ou au preneur de licence de présenter la requête d’inscription d’une licence.

2 Celle-ci doit contenir:

a.
une déclaration expresse du titulaire ou toute autre pièce jugée suffisante de laquelle il ressort que le titulaire autorise le preneur de licence à utiliser le design;
b.
le nom et le prénom ou la raison sociale du preneur de licence ainsi que son adresse;
c.
l’indication que la licence inscrite est une licence exclusive si tel est le cas;
d.
l’indication des droits sur lesquels porte la licence partielle.

3 Les al. 1 et 2 s’appliquent par analogie à l’inscription d’une sous-licence. En outre, il faut apporter la preuve que le preneur de licence est habilité à octroyer des sous-licences.

4 Tant qu’une licence exclusive est inscrite dans le registre, aucune autre licence incompatible avec elle n’y est inscrite pour le même design.45
