Art. 403 IV. Liability of joint mandators and mandatees

1 Where several persons conclude a mandate as mandators, they are jointly and severally liable to the mandatee.

2 Where several persons conclude a mandate as mandatees, they are jointly and severally liable to the mandator and, save to the extent they are authorised to delegate to third parties, may commit the mandator only through joint action.

Art. 402 III. Obligations du mandant

1 Le mandant doit rembourser au mandataire, en principal et intérêts, les avances et frais que celui-ci a faits pour l’exécution régulière du mandat, et le libérer des obligations par lui contractées.

2 Il doit aussi l’indemniser du dommage causé par l’exécution du mandat, s’il ne prouve que ce dommage est survenu sans sa faute.
