Whether a collective investment scheme counts as a financial counterparty or as a small financial counterparty is determined on the basis of the OTC derivatives transactions carried out for its own account in accordance with Article 99 FinMIA, regardless of whether it can be ascribed legal personality or not.

Ob eine kollektive Kapitalanlage als Finanzielle Gegenpartei oder als kleine Finanzielle Gegenpartei gilt, bestimmt sich unbesehen, ob ihr Rechtspersönlichkeit zukommt oder nicht, entsprechend den nach Massgabe von Artikel 99 FinfraG auf ihre Rechnung getätigten OTC-Derivatgeschäften.
