Art. 61 Exchange of data with other countries and with international organisations

¹ The Federal Council shall regulate the responsibilities and procedures for exchanging personal data with foreign authorities and institutions and with international organisations.

² Data on administrative and criminal proceedings may only be passed on to foreign authorities and institutions or to international organisations if:

a.: this is required by international agreements or decisions of international organisations; or
b.: it is absolutely necessary in order to avert an imminent risk to health.

Art. 61 Datenaustausch mit dem Ausland und mit internationalen Organisationen

¹ Der Bundesrat regelt Zuständigkeiten und Verfahren für den Austausch von Personendaten mit ausländischen Behörden und Institutionen sowie mit internationalen Organisationen.

² Daten über administrative und strafrechtliche Verfolgungen dürfen an ausländische Behörden und Institutionen sowie an internationale Organisationen nur weitergegeben werden, wenn:

a.: völkerrechtliche Verträge oder Beschlüsse internationaler Organisationen dies erfordern; oder
b.: es zur Abwendung unmittelbar drohender Gefahr für die Gesundheit unbedingt erforderlich ist.
