Art. 28 Data protection period

1 For data submitted to the Notification Authority in accordance with this Ordinance, the following protection periods apply:

a.
for data submitted with a view to the approval of an existing active substance: 10 years from the first day of the month following the date of the approval of the relevant active substance for the particular product type by the European Commission in accordance with Article 9 of Regulation (EU) No 528/2012138;
b.
for data submitted with a view to the approval of a new active substance: 15 years from the first day of the month following the date of the approval of the relevant active substance for the particular product type by the European Commission in accordance with Article 9 of Regulation (EU) No 528/2012;
c.
for data submitted with a view to the renewal or review of the approval of a new active substance: 5 years from the first day of the month following the date of the renewal or review of the approval by the European Commission in accordance with Article 14 paragraph 4 of Regulation (EU) No 528/2012;
d.
for data submitted with a view to the authorisation of a biocidal product containing only existing active substances: 10 years from the first day of the month following the date of the authorisation by the Notification Authority or by the competent authority in accordance with Regulation (EU) No 528/2012;
e.
for data submitted with a view to the authorisation of a biocidal product containing a new active substance: 15 years from the first day of the month following the date of the authorisation by the Notification Authority or by the competent authority in accordance with Regulation (EU) No 528/2012;
f.
for data submitted with a view to the renewal or amendment of the authorisation of a biocidal product: 5 years from the first day of the month following the date of the authorisation by the Notification Authority or the date of the decision concerning the renewal or amendment of the authorisation by the competent authority in accordance with Regulation (EU) No 528/2012.

2 The protection period shall start when data is submitted for the first time.

3 It cannot be renewed.

4 By way of derogation from paragraph 1, the data protection periods for existing active substances listed in combination with a product type in Annex II to Regulation (EU) No 1062/2014139 – including data not involving tests on vertebrates – but for which a decision on inclusion in Annex I to Directive 98/8/EC140 was not taken before 1 September 2013 shall expire no later than 31 December 2025.141

Art. 28 Schutzdauer für Daten

1 Für die nach dieser Verordnung der Anmeldestelle übermittelten Daten gelten folgende Schutzdauern:

a.
für Daten, die zum Zweck der Genehmigung eines alten Wirkstoffs übermittelt wurden: 10 Jahre nach dem ersten Tag des Monats, der auf den Zeitpunkt der Genehmigung des betreffenden Wirkstoffs für die betreffende Produktart durch die Europäische Kommission nach Artikel 9 der Verordnung (EU) Nr. 528/2012138 folgt;
b.
für Daten, die zum Zweck der Genehmigung eines neuen Wirkstoffs übermittelt wurden: 15 Jahre nach dem ersten Tag des Monats, der auf den Zeitpunkt der Genehmigung des betreffenden Wirkstoffs für die betreffende Produktart durch die Europäische Kommission nach Artikel 9 der Verordnung (EU) Nr. 528/2012 folgt;
c.
für Daten, die zum Zweck der Verlängerung oder Überprüfung der Genehmigung eines neuen Wirkstoffs übermittelt wurden: 5 Jahre nach dem ersten Tag des Monats, der auf den Zeitpunkt der Verlängerung oder Überprüfung der Genehmigung durch die Europäische Kommission nach Artikel 14 Absatz 4 der Verordnung (EU) Nr. 528/2012 folgt;
d.
für Daten, die zum Zweck einer Zulassung eines Biozidprodukts, das nur alte Wirkstoffe enthält, übermittelt wurden: 10 Jahre nach dem ersten Tag des Monats, der nach der Zulassung durch die Anmeldestelle oder durch die nach der Verordnung (EU) Nr. 528/2012 zuständige Behörde folgt;
e.
für Daten, die zum Zweck einer Zulassung eines Biozidprodukts, das einen neuen Wirkstoff enthält, übermittelt wurden: 15 Jahre nach dem ersten Tag des Monats, der nach der Zulassung durch die Anmeldestelle oder durch die nach der Verordnung (EU) Nr. 528/2012 zuständige Behörde folgt;
f.
für Daten, die zum Zweck der Verlängerung oder Änderung einer Zulassung eines Biozidprodukts übermittelt wurden: 5 Jahre nach dem ersten Tag des Monats, der auf den Zeitpunkt der Zulassung durch die Anmeldestelle oder auf den Zeitpunkt der Entscheidung über Verlängerung oder Änderung der Zulassung durch die nach der Verordnung (EU) Nr. 528/2012 zuständige Behörde folgt.

2 Der Schutzdauer beginnt mit der erstmaligen Übermittlung der Daten.

3 Sie kann nicht erneuert werden.

4 Abweichend von Absatz 1 laufen die Schutzdauern für alte Wirkstoffe, die für die jeweilige Produktart nach Anhang II der Verordnung (EU) Nr. 1062/2014139 aufgeführt sind, einschliesslich der Daten, die keine Versuche an Wirbeltieren beinhalten, und über deren Aufnahme in Anhang I der Richtlinie 98/8/EG140 bis zum 1. September 2013 aber noch nicht entschieden wurde, spätestens am 31. Dezember 2025 ab.141
