Art. 13 Authorisation AN

1 A biocidal product shall be granted authorisation AN provided the applicant demonstrates that, according to the latest scientific and technical knowledge, and when used as intended:94

a.
no unacceptable effects on humans, animals or the environment are to be expected from it or its residues; and
b.
in the case of a wood preservative or a disinfectant: it is sufficiently effective.
2 It shall only be authorised for placing on the market for use by the general public if it has none of the properties mentioned in Article 11d.95

Art. 13 Zulassung ZN

1 Ein Biozidprodukt wird im Sinne der Zulassung ZN zugelassen, wenn die Gesuchstellerin nachweist, dass nach dem neuesten Stand von Wissenschaft und Technik und bei bestimmungsgemässer Verwendung:94

a.
von ihm und seinen Rückständen keine unannehmbaren Wirkungen auf Mensch, Tier und Umwelt zu erwarten sind; und
b.
sofern es sich um ein Holzschutzmittel oder ein Desinfektionsmittel handelt: es hinreichend wirksam ist.

2 Für das Inverkehrbringen zur Verwendung durch die breite Öffentlichkeit wird es nur zugelassen, wenn es keine der Eigenschaften nach Artikel 11d aufweist.95
