Art. 12 Recognition

1 An authorisation from a Member State of the EU or EFTA shall be recognised if there is nothing to suggest that the product could not also be authorised in Switzerland.

2 The Notification Authority, in consultation with the assessment authorities, may amend the conditions or requirements imposed with the authorisation in an EU or EFTA Member State on the basis of the evaluation in accordance with Article 17 or a comparative assessment in accordance with Article 11g, provided that such a measure can be justified on the following grounds:

a.
the protection of the environment;
b.
the protection of health and life of humans, particularly of vulnerable groups, or of animals or plants;
c.
public policy or public security;
d.
the protection of national treasures possessing artistic, historic or archaeological value; or
e.
the target organisms not being present in harmful quantities.

3 The labelling and safety data sheet must be adapted to the requirements set out in Articles 38 and 40.

4 Authorisations of biocidal products consisting of or containing genetically modified microorganisms shall not be recognised.

5 Article 14abis applies to the recognition of a Union authorisation.

Art. 12 Anerkennung

1 Eine Zulassung eines EU- oder EFTA-Mitgliedstaates wird anerkannt, wenn keine Anhaltspunkte dafür vorliegen, dass das Produkt nicht auch in der Schweiz zugelassen werden könnte.

2 Die Anmeldestelle kann im Einvernehmen mit den Beurteilungsstellen die mit der Zulassung in einem EU- oder EFTA-Mitgliedstaat auferlegten Bedingungen oder Auflagen aufgrund der Bewertung nach Artikel 17 oder einer vergleichenden Bewertung nach Artikel 11g abändern, wenn dies wie folgt begründet werden kann:

a.
mit dem Schutz der Umwelt;
b.
mit dem Schutz der Gesundheit und des Lebens von Menschen, insbesondere von gefährdeten Gruppen, oder von Tieren oder Pflanzen;
c.
mit dem Schutz der öffentlichen Ordnung und Sicherheit;
d.
mit dem Schutz des nationalen Kulturguts von künstlerischem, geschichtlichem oder archäologischem Wert; oder
e.
mit dem Umstand, dass die Zielorganismen nicht in schädlichen Mengen vorkommen.

3 Kennzeichnung und Sicherheitsdatenblatt müssen an die Vorschriften nach den Artikeln 38 und 40 angepasst werden.

4 Zulassungen von Biozidprodukten, die gentechnisch veränderte Mikroorganismen sind oder enthalten, werden nicht anerkannt.

5 Für die Anerkennung einer Unionszulassung gilt Artikel 14abis.
