Art. 29 Use of data from previous notifiers

1 If the Notification Authority finds that a new substance has already been notified in Switzerland, it shall inform the notifier of the names and addresses of the earlier notifiers.78

1bis The Notification Authority may refer to data from a previous notifier instead of data produced by the notifier if:

a.
the new notifier proves with a letter of access from a previous notifier that the latter agrees to the Notification Authority consulting its data; or
b.
the data protection period has expired.79

2 The notifier must not refer to data from previous notifiers regarding:

a.
the identity and purity of the substance and the nature of any impurities;
b.
action to render the substance harmless.

3 The rules of competition and intellectual property law are not affected by the provisions of this section.

Art. 29 Verwendung von Daten früherer Anmelderinnen

1 Stellt die Anmeldestelle fest, dass ein neuer Stoff bereits in der Schweiz angemeldet wurde, so teilt sie der Anmelderin die Namen und Adressen der früheren Anmelderinnen mit.78

1bis Die Anmeldestelle verzichtet auf Daten der Anmelderin und legt diejenigen einer früheren Anmelderin zu Grunde, wenn:

a.
die neue Anmelderin mit einer Zugangsbescheinigung einer früheren Anmelderin nachweist, dass diese damit einverstanden ist, dass die Anmeldestelle auf ihre Daten zurückgreift; oder
b.
die Schutzdauer für die Daten abgelaufen ist.79

2 Die Anmelderin darf auf folgende Daten früherer Anmelderinnen nicht verweisen:

a.
Identität, Reinheit und Art der Verunreinigungen des Stoffs;
b.
Unschädlichmachung des Stoffs.

3 Die Regelungen des Wettbewerbs- und des Immaterialgüterrechts werden durch die Bestimmungen dieses Abschnitts nicht berührt.
