Art. 20 Obligations of registrars

1 Registrars must propose an offering consisting exclusively of the allocation of a domain name (unbundled offering).

2 They must guarantee their customers at all times the opportunity to transfer the administrative management of a domain name to a new registrar. Civil claims for non-execution of the contract are reserved.

3 Registrars must retain commercial correspondence, supporting documentation, titles and log files classified according to domain names for a period of 10 years from the end of registration of a domain name. They shall present them, on request, to the registry within 3 working days at the latest.

4 Registrars must:

a.
collaborate with the registry and provide it with all necessary technical and organisational assistance and support in order to ensure the continuity and the security of the administration of the domain names;
b.
ensure that holders of the domain names for which they provide administrative management are informed of the cessation of any registrar’s activities and of the steps to be taken to safeguard their claims.

Art. 20 Pflichten der Registrare

1 Die Registrare müssen ein Angebot unterbreiten, das ausschliesslich die Zuteilung eines Domain-Namens beinhaltet (entbündeltes Angebot).

2 Sie müssen ihren Kundinnen oder Kunden jederzeit die Möglichkeit bieten, die administrative Verwaltung eines Domain-Namens an einen anderen Registrar zu transferieren. Vorbehalten bleiben zivilrechtliche Forderungen wegen Nichterfüllung des Vertrags.

3 Sie müssen die Geschäftskorrespondenz, Belege, Titel und Journaldateien (log files), geordnet nach Domain-Namen, während zehn Jahren ab Aufhebung der Registrierung aufbewahren. Auf Verlangen sind diese der Registerbetreiberin innerhalb von maximal drei Werktagen herauszugeben.

4 Die Registrare müssen:

a.
mit der Registerbetreiberin zusammenarbeiten und ihr jede notwendige technische und organisatorische Hilfe und Unterstützung zur Gewährleistung der Kontinuität und Sicherheit der Verwaltung der Domain-Namen leisten;
b.
sicherstellen, dass die Halterinnen und Halter von Domain-Namen über eine allfällige Einstellung der Registrartätigkeit informiert werden und ihnen das Vorgehen zur Wahrung ihrer Ansprüche bekannt ist.
