Art. 37 Powers

1 OFCOM shall be authorised to demand from economic operators any necessary documents and information which may prove that telecommunications installations comply with the provisions of this Ordinance and its regulations, to demand the delivery, without charge, of the necessary telecommunications installations in order to test them or have them tested by a laboratory mentioned in Article 17.

2 During the inspections, the user must provide the following:

a.
the documents for the telecommunications installation that are in its possession; and
b.
the information required to identify the person responsible for making the telecommunications installation available on the market.

Art. 37 Befugnisse

1 Das BAKOM ist ermächtigt, von den Wirtschaftsakteurinnen die zum Nachweis der Konformität der Fernmeldeanlagen mit den Bestimmungen dieser Verordnung und seinen eigenen Vorschriften notwendigen Dokumente und Informationen sowie die unentgeltliche Übergabe der betreffenden Fernmeldeanlagen zu verlangen, um sie zu prüfen oder von einer in Artikel 17 bezeichneten Prüfstelle prüfen zu lassen.

2 Bei den Kontrollen müssen die Benutzerinnen und Benutzer Folgendes vorlegen:

a.
die Dokumente für die Fernmeldeanlage, die in ihrem Besitz sind; und
b.
die Informationen, die zur Identifizierung der für die Bereitstellung auf dem Markt verantwortlichen Person dienlich sind.
