Art. 32 Offences under the Nuclear Energy Act

Under Article 93 NEA, it is an offence for any person:

a.
to fail to comply with the obligation of establishing a zone in accordance with Articles 7 and 12;
b.
to fail to comply with the accounting, reporting and notification requirements specified in Articles 9, 10, 14, 16, 18, 19, 22 and 23;
c.
to fail to comply with the notification requirement specified in Article 21 in relation to facilities;
d.
to prevent inspections in accordance with Article 24 relating to the accounting, reporting and notification requirements mentioned in letters b and c from being carried out;
e.
to fail to comply with the obligations to tolerate and cooperate specified in Article 26 in the course of inspections in accordance with letter d.

Art. 32 Strafbarkeit nach dem Kernenergiegesetz

Nach Artikel 93 KEG wird bestraft, wer:

a.
gegen die Pflicht zur Festlegung einer Zone nach den Artikeln 7 und 12 verstösst;
b.
gegen die Buchführungs-, Berichterstattungs- und Meldepflichten nach den Artikeln 9, 10, 14, 16, 18, 19, 22 und 23 verstösst;
c.
gegen die Meldepflicht nach Artikel 21 in Bezug auf Anlagen verstösst;
d.
verhindert, dass Inspektionen nach Artikel 24 zur Überprüfung der Buchführungs-, Berichterstattungs- und Meldepflichten nach den Buchstaben b und c durchgeführt werden;
e.
gegen Duldungs- und Mitwirkungspflichten nach Artikel 26 im Rahmen von Inspektionen nach Buchstabe d verstösst.
