Art. 13 Assistance in the event of political or terrorist kidnappings and hostage-taking

¹ For assistance in the event of political or terrorist kidnappings and hostage-taking, persons who have acted negligently shall pay:

a.

the costs directly attributable to them, in particular for:

1.: their transport,
2.: their medical care,
3.: their clothing,
4.: other aid from which they have directly benefited,
5.: the transport of such aid;

b.

the operational costs related to the case, consisting of the costs for:

1.: the services provided by the representation based on time spent,
2.: travel accommodation and meals costs for public employees,
3.: services of third parties retained,
4.: additional infrastructures at third locations,
5.: the procurement of information and documents, including the associated staff costs,
6.: communication and transmission.

² The following persons shall only pay the costs directly attributable to them:

a.: persons who have not acted negligently;
b.: persons with multiple nationalities if another country provides consular protection;
c.: employees of international organisations, the persons who are recognised by the employer as accompanying such employees and the children of these persons, if the international organisation is handling the case under its own authority and the Confederation is only acting in a complementary capacity.

³ The following persons are exempt from the obligation to pay a fee if the kidnapping or hostage-taking occurred during an official assignment abroad:

a.: public employees, the persons who are recognised by the employer as accompanying such employees and the children of these persons;
b.: persons who are directly assigned by the government, the persons who are recognised by the employer as accompanying such persons and the children of these persons.

⁴ No interim invoices will be issued for assistance in connection with kidnappings and hostage-taking.

Art. 13 Hilfeleistungen bei Entführungen und Geiselnahmen mit politischem oder terroristischem Hintergrund

¹ Personen, die sich fahrlässig verhalten haben, bezahlen für Hilfeleistungen bei Entführungen und Geiselnahmen mit politischem oder terroristischem Hintergrund:

a.

die ihnen direkt persönlich zurechenbaren Kosten, insbesondere die Kosten für:

1.: ihren Transport,
2.: ihre medizinische Versorgung,
3.: ihre Bekleidung,
4.: weitere Hilfsgüter, die ihnen direkt persönlich zugute kommen,
5.: die Übermittlung der genannten Hilfsgüter;

b.

die fallbezogenen operationellen Kosten, bestehend aus den Kosten für:

1.: die Dienstleistungen der Vertretung nach Zeitaufwand,
2.: Reisen, Unterkunft und Verpflegung von Angestellten des öffentlichen Dienstes,
3.: Dienstleistungen beigezogener Dritter,
4.: zusätzliche Infrastrukturen an Drittstandorten,
5.: die Beschaffung von Informationen und Unterlagen, inklusive der dafür aufgewendeten Saläre,
6.: Kommunikation und Übermittlung.

² Die folgenden Personen bezahlen ausschliesslich die ihnen direkt persönlich zurechenbaren Kosten:

a.: Personen, die sich nicht fahrlässig verhalten haben;
b.: Personen mit mehrfacher Staatsangehörigkeit, wenn ein anderer Staat den konsularischen Schutz wahrnimmt;
c.: Mitarbeitende von internationalen Organisationen, ihre vom Arbeitgeber anerkannten Begleitpersonen sowie Kinder dieser Personen, wenn die internationale Organisation den Fall in eigener Kompetenz bewältigt und der Bund nur komplementär tätig wird.

³ Die folgenden Personen sind von der Gebührenpflicht befreit, wenn die Entführung oder Geiselnahme im Rahmen des dienstlichen Aufenthaltes geschah:

a.: Angestellte des öffentlichen Dienstes, ihre vom Arbeitgeber anerkannten Begleitpersonen sowie Kinder dieser Personen;
b.: Personen, die vom öffentlichen Dienst direkt beauftragt sind, ihre vom Auftraggeber anerkannten Begleitpersonen sowie Kinder dieser Personen.

⁴ Für Hilfeleistungen im Zusammenhang mit Entführungen und Geiselnahmen ergeht keine Zwischenabrechnung.
