Art. 41 Authorisation procedure

¹ If the FIS intends to issue a mandate for cable communications intelligence, it shall file an application with Federal Administrative Court that includes:

a.: a description of the mandate to be issued to the service carrying out the communications intelligence;
b.: the reasons why the operation is necessary;
c.: details of the categories of search parameters;
d.: details of the operators of cable-based networks and the providers of telecommunications services that must supply the signals required to conduct the cable communications intelligence; and
e.: details of when the operation will start and finish.

² The further procedure is governed by Articles 29–32.

³ Authorisation applies for a maximum of six months. This period may be extended for a maximum of three months in any given case in accordance with the same procedure.

Art. 41 Genehmigungsverfahren

¹ Beabsichtigt der NDB, einen Auftrag zur Kabelaufklärung zu erteilen, so unterbreitet er dem Bundesverwaltungsgericht einen Antrag mit:

a.: der Beschreibung des Auftrags an den durchführenden Dienst;
b.: der Begründung der Notwendigkeit des Einsatzes;
c.: der Angabe der Kategorien von Suchbegriffen;
d.: der Angabe der Betreiberinnen von leitungsgebundenen Netzen und der Anbieterinnen von Telekommunikationsdienstleistungen, welche die für die Durchführung der Kabelaufklärung notwendigen Signale liefern müssen; und
e.: der Angabe von Beginn und Ende des Auftrags.

² Das weitere Verfahren richtet sich nach den Artikeln 29–32.

³ Die Genehmigung gilt für höchstens sechs Monate. Sie kann nach demselben Verfahren um jeweils höchstens drei Monate verlängert werden.
