Art. 80 Prüfbericht

(Art. 52 Abs. 1 und 53 FINIG)

1 Die Prüfgesellschaft übermittelt ihren Bericht:

a.
der Aufsichtsorganisation zuhanden der FINMA im Falle von Artikel 52 Absatz 1 Buchstabe a FINIG;
b.
der FINMA im Falle von Artikel 52 Absatz 1 Buchstaben b–e FINIG.

2 Sie stellt der verantwortlichen Leiterin oder dem verantwortlichen Leiter der Zweigniederlassung eine Kopie zu.

3 Die Zweigniederlassung übermittelt die Kopie des Prüfberichts der Stelle des ausländischen Finanzinstituts, die für die Geschäftstätigkeit der Zweigniederlassung zuständig ist.

Art. 80 Audit report

(Art. 52 para. 1 and 53 FinIA)

1 The audit firm shall send its audit report:

a.
to the supervisory organisation for submission to FINMA in the case of Article 52 paragraph 1 letter a FinIA;
b.
to FINMA in the case of Article 52 paragraph 1 letters b–e FinIA.

2 It shall provide a copy to the branch manager responsible.

3 The branch will send the copy of the audit report to the unit of the foreign financial institution which is responsible for the business activities of the branch.
