Art. 59 Bewilligungsvoraussetzungen

1 Die FINMA erteilt dem ausländischen Finanzinstitut eine Bewilligung zur Errichtung einer Vertretung, wenn:

a.
das ausländische Finanzinstitut einer angemessenen Aufsicht untersteht;
b.
die zuständigen ausländischen Aufsichtsbehörden keine Einwände gegen die Errichtung der Vertretung erheben;
c.
die mit ihrer Leitung betrauten Personen Gewähr für eine einwandfreie Geschäftstätigkeit bieten.

2 Die FINMA kann die Bewilligung zusätzlich davon abhängig machen, dass der Staat, in dem das ausländische Finanzinstitut seinen Sitz hat, das Gegenrecht gewährleistet.

Art. 59 Authorisation conditions

1 FINMA shall grant the foreign financial institution authorisation to establish a representation if:

a.
the foreign financial institution is subject to appropriate supervision;
b.
the competent foreign supervisory authorities do not raise any objections to the establishment of the representation;
c.
the persons entrusted with its management provide a guarantee of irreproachable business conduct.

2 FINMA may make authorisation additionally contingent upon the granting of reciprocity by the state in which the foreign financial institution has its registered office.
