Art. 99 Zulässige Anlagen

(Art. 69 KAG)

¹ Als Anlagen von übrigen Fonds sind namentlich zugelassen:

a.: Effekten;
b.: Anteile an kollektiven Kapitalanlagen;
c.: Geldmarktinstrumente;
d.: Guthaben auf Sicht und auf Zeit mit Laufzeiten bis zu zwölf Monaten;
e.: Edelmetalle;
f.: derivative Finanzinstrumente, denen als Basiswerte Effekten, kollektive Kapitalanlagen, Geldmarktinstrumente, derivative Finanzinstrumente, Indizes, Zinssätze, Wechselkurse, Kredite, Währungen, Edelmetalle, Commodities oder ähnliches zu Grunde liegen;
g.: strukturierte Produkte, die sich auf Effekten, kollektive Kapitalanlagen, Geldmarktinstrumente, derivative Finanzinstrumente, Indizes, Zinssätze, Wechselkurse, Währungen, Edelmetalle, Commodities oder ähnliches beziehen.

² Für übrige Fonds für alternative Anlagen kann die FINMA weitere Anlagen wie Commodities, Rohstoffe und die entsprechenden Rohstofftitel zulassen.¹⁴⁴

³ Anlagen gemäss Artikel 69 Absatz 2 des Gesetzes sind im Fondsreglement ausdrücklich zu nennen.

⁴ Für Anlagen in Anteile an kollektiven Kapitalanlagen gilt Artikel 73 Absatz 4 sinngemäss.

Art. 99 Permitted investments

(Art. 69 CISA)

¹ The following investments are specifically admitted for other funds:

a.: securities;
b.: units in collective investment schemes;
c.: money market instruments;
d.: sight and time deposits with a term of up to twelve months;
e.: precious metals;
f.: derivative financial instruments whose underlyings are securities, collective investment schemes, money market instruments, derivative financial instruments, indices, interest rates, exchange rates, loans, currencies, precious metals, commodities or similar instruments;
g.: structured products relating to securities, collective investment schemes, money market instruments, derivative financial instruments, indices, interest rates, exchange rates, currencies, precious metals, commodities or similar instruments.

² In the case of other funds for alternative investments, FINMA may admit other investments such as commodities and the corresponding commodity certificates.¹⁴⁴

³ Investments as defined in Article 69 paragraph 2 of the Act must be explicitly named in the fund regulations.
