Art. 42 Vergehen

¹ Mit Freiheitsstrafe bis zu einem Jahr oder Geldstrafe wird bestraft, wer vorsätzlich:⁶²

a.: ohne Berechtigung rodet;
b.: durch unwahre oder unvollständige Angaben oder in anderer Weise für sich oder einen anderen eine Leistung erwirkt, die ihm nicht zusteht;
c.: eine vorgeschriebene Schaffung von Wald unterlässt oder verhindert.

² Handelt der Täter fahrlässig, ist die Strafe Busse bis zu 40 000 Franken.

Art. 42 Misdemeanours

¹ Any person who wilfully:⁶²

a.: clears forest without authorisation;
b.: obtains a payment for himself or others, to which he is not entitled by providing untrue or incomplete information;
c.: fails to comply with or hinders the prescribed generation of forest

shall be liable to a custodial sentence not exceeding one year or to a monetary penalty.

² If the offender acts negligently, he or she shall be liable to a monetary penalty not exceeding 40,000 Swiss francs.
