Art. 5 Einschliessungspflicht und vorgängige Beurteilungen

¹ Der Umgang mit folgenden Organismen muss in geschlossenen Systemen erfolgen, ausser wenn mit ihnen nach der Freisetzungsverordnung vom 10. September 2008¹⁴, der Pflanzenschutzmittelverordnung vom 12. Mai 2010¹⁵ oder der Biozidprodukteverordnung vom 18. Mai 2005¹⁶ in der Umwelt umgegangen werden darf:

a.

gentechnisch veränderte Organismen;

b.

pathogene Organismen;

c.¹⁷

einschliessungspflichtige gebietsfremde Organismen:

1.: gebietsfremde wirbellose Kleintiere,
2.: invasive gebietsfremde Organismen nach Anhang 2 der Freisetzungsverordnung, und
3.: Organismen, die nach der Verordnung, die das Eidgenössische Departement für Wirtschaft, Bildung und Forschung und das Eidgenössische Departement für Umwelt, Verkehr, Energie und Kommunikation gestützt auf die Artikel 4 Absatz 3, 24 Absatz 2 und 29 Absatz 2 der Pflanzengesundheitsverordnung vom 31. Oktober 2018¹⁸ erlassen haben, als besonders gefährliche Schadorganismen gelten, und Organismen, die nach der Verordnung, die das Bundesamt für Landwirtschaft (BLW) beziehungsweise das Bundesamt für Umwelt (BAFU) gestützt auf Artikel 5 Absatz 2 der Pflanzengesundheitsverordnung erlassen haben, als potenzielle Quarantäneorganismen gelten.

² Wer mit Organismen in geschlossenen Systemen umgeht, muss vorher das Risiko, das vom Vorkommen der Organismen ausgeht, ermitteln und bewerten (Gruppierung der Organismen) und anschliessend das Risiko der geplanten Tätigkeiten mit den Organismen ermitteln und bewerten (Klassierung der Tätigkeiten).

³ Wer mit gentechnisch veränderten Tieren und Pflanzen in geschlossenen Systemen umgeht, muss vorher mittels Interessenabwägung nach Artikel 8 GTG sicherstellen, dass die Würde der Kreatur nicht missachtet wird.

Art. 5 Containment obligation and prior assessments

¹ The following organisms must be handled only in contained systems unless they may be handled in the environment in accordance with the Release Ordinance of 10 September 2008¹⁵, the Plant Protection Products Ordinance of 12 May 2010¹⁶ or the Biocidal Products Ordinance of 18 May 2005¹⁷:

a.

genetically modified organisms;

b.

pathogenic organisms;

c.¹⁸

organisms subject to a containment obligation:

1.: alien small invertebrates,
2.: invasive alien organisms as defined in Annex 2 of the Release Ordinance, and
3.: harmful organisms that are considered particularly dangerous in accordance with the Ordinance issued by the Federal Department of Economic Affairs, Education and Research and the Federal Department of the Environment, Transport, Energy and Communications based on Articles 4 paragraph 3, 24 paragraph 2 and 29 paragraph 2 of the Plant Health Ordinance of 31 October 2018¹⁹, and organisms that are considered potential quarantine organisms in accordance with the Ordinance issued by the Federal Office for Agriculture (FOAG) and the Federal Office for the Environment (FOEN) based on Article 5 paragraph 2 of the Plant Health Ordinance.

² Any person who handles organisms in contained systems must first determine and assess the risk of the occurrence of the organisms (allocate the organisms to a group) and thereafter determine and assess the risk due to the planned activities with the organisms (classify the activities).

³ Any person who handles genetically modified animals and plants in contained systems must first ensure by weighing the interests in accordance with Article 8 GTA that the dignity of living beings is respected.
