Art. 18 Zuständiges Bundesamt und Fachstellen

1 Für die im Zusammenhang mit melde- oder bewilligungspflichtigen Tätigkeiten erforderlichen Entscheide zuständig ist:

a.
das Bundesamt für Gesundheit (BAG), wenn bei der Tätigkeit das Risiko für den Menschen im Vordergrund steht;
b.
das BAFU bei allen übrigen Tätigkeiten.

2 Als Fachstellen gelten:

a.
für alle Tätigkeiten das BAG, das BAFU, die Eidgenössische Ethikkommission für die Biotechnologie im Ausserhumanbereich (EKAH), die vom Kanton bezeichnete Fachstelle sowie, auf dessen Antrag, das Staatssekretariat für Wirtschaft (SECO);
b.
für Tätigkeiten der Klassen 2‒4 die Schweizerische Unfallversicherungsanstalt (SUVA);
c.
für Tätigkeiten der Klassen 3 und 4 sowie für Gesuche nach Artikel 12 Absatz 3 Buchstabe a die EFBS;
d.
für Tätigkeiten mit tierpathogenen Organismen das Bundesamt für Lebensmittelsicherheit und Veterinärwesen (BLV)30;
e.
für Tätigkeiten mit pflanzenpathogenen und einschliessungspflichtigen gebietsfremden Organismen das Bundesamt für Landwirtschaft (BLW).

3 Sind das BAG, das BAFU, das BLW oder das BLV Fachstellen, so entscheidet das zuständige Bundesamt mit deren Zustimmung, soweit die Vereinbarkeit mit den von diesen Stellen zu vollziehenden Gesetzen in Frage steht.

4 Bei Tätigkeiten mit hochansteckenden Seuchen nach Artikel 2 TSV31, die ausserhalb des Instituts für Virologie und Immunologie32 (IVI) durchgeführt werden sollen, koordiniert das zuständige Bundesamt seinen Entscheid mit demjenigen des BLV nach Artikel 49 Absatz 2 TSV.

Art. 18 Competent federal office and specialist agencies

1 The following offices are competent to take the decisions required in connection with activities subject to notification or authorisation:

a.
the Federal Office of Public Health (FOPH) where the main risk of an activity concerns human beings;
b.
the FOEN for all other activities.

2 The following are the specialist agencies:

a.
for all activities, the FOPH, the FOEN, the Federal Ethics Committee on Non-Human Biotechnology (ECNH), the specialist agency appointed by the canton, and, at its request, the State Secretariat for Economic Affairs (SECO);
b.
for activities in Classes 2‒4, the Swiss National Accident Insurance Fund (SUVA);
c.
for activities in Classes 3 and 4 and applications under Article 12 paragraph 3 letter a, the SECB;
d.
for activities with organisms pathogenic to animals, the Federal Food Safety and Veterinary Office (FSVO)31;
e.
for activities with organisms pathogenic to plants and alien organisms subject to a containment obligation, the Federal Office for Agriculture (FOAG).

3 If the FOPH, the FOEN, the FOAG or the FSVO are the specialist agencies, the competent federal office decides with their consent in cases where the matter in question relates to compliance with the legislation enforced by these agencies.

4 In the case of activities with highly contagious epizootic diseases under Article 2 TSV32 that are intended to be carried out outside the Institute for Virology and Immunology (IVI)33, the competent federal office coordinates its decision with that of the FSVO under Article 49 paragraph 2 EzDO.
