Art. 17 Kontaktstelle Biotechnologie des Bundes

¹ Der Bund führt beim Bundesamt für Umwelt (BAFU) eine Kontaktstelle Biotechnologie.

² Die Kontaktstelle hat folgende administrative Aufgaben:

a.

sie nimmt die Meldungen und Bewilligungsgesuche nach den Artikeln
8–12 sowie die Meldungen nach der Verordnung vom 25. August 1999²⁸ über den Schutz der Arbeitnehmerinnen und Arbeitnehmer vor Gefährdung durch Mikroorganismen entgegen;

b.

sie prüft die Meldungen und Bewilligungsgesuche, fordert allfällige fehlende Angaben innert 20 Tagen nach und bestätigt die Vollständigkeit der meldenden oder gesuchstellenden Person;

c.

sie übermittelt die vollständigen Meldungen und Bewilligungsgesuche dem zuständigen Bundesamt (Art. 18 Abs. 1) zum Entscheid und den Fachstellen (Art. 18 Abs. 2) zur Stellungnahme;

d.

sie zeigt den Eingang der Meldungen und Bewilligungsgesuche im Bundesblatt an und macht die Meldungen und Bewilligungsgesuche, soweit sie nicht vertraulich sind, öffentlich zugänglich;

e.

sie führt die Termin- und Geschäftskontrolle zu den eingegangenen Meldungen und Bewilligungsgesuchen;

sie führt die elektronische Datenbank ECOGEN (Art. 27a);

g.

sie führt ein Verzeichnis der gemeldeten und bewilligten Tätigkeiten und macht dieses sowie die Ergebnisse der Erhebungen nach Artikel 27, soweit keine vertraulichen Angaben betroffen sind, über automatisierte Informations- und Kommunikationsdienste öffentlich zugänglich;

h.

sie ist Auskunfts- und Beratungsstelle zu Anfragen über:

1.: die Abläufe und den Stand von Melde- und Bewilligungsverfahren,
2.: Formulare, Richtlinien und ausländische Normen sowie Kontaktadressen innerhalb der Bundesverwaltung,
3.: die Liste der zugeordneten Organismen;

i.

sie kann in ihrer Funktion als Auskunfts- und Beratungsstelle Kurse und Schulungen durchführen;

j.

sie nimmt von den Kantonen Informationen und Berichte über ihre Kontrolltätigkeit nach Artikel 23 entgegen, übermittelt sie unverzüglich den zuständigen Bundesämtern und erstellt jährlich eine Übersicht über die Kontrolltätigkeiten nach dieser Verordnung.

Art. 17 Federal Coordination Centre for Biotechnology

¹ The Confederation operates a Coordination Centre for Biotechnology within the Federal Office for the Environment (FOEN).

² The Coordination Centre has the following administrative duties:

a.

it accepts notifications and authorisation applications under Articles 8–12 as well as notifications under the Ordinance of 25 August 1999²⁹ on the Protection of Employees from Dangerous Organisms;

b.

it examines the notifications and authorisation applications, requests any missing information within 20 days and confirms to the person filing the notification or application that the document is complete;

c.

it forwards complete notifications and authorisation applications to the competent federal office (Art. 18 para. 1) for a decision and to the specialist agencies (Art. 18 para. 2) for an opinion;

d.

it gives notice of receipt of notifications and authorisation applications in the Official Federal Gazette and makes these notifications and authorisation applications available for public inspection unless they are confidential;

e.

it monitors progress in processing the notifications and authorisation applications received;

it maintains the ECOGEN electronic database (Art. 27a);

g.

it maintains a register of notified and authorised activities and makes this information, and the results of surveys under Article 27, publicly accessible via automated information and communications services unless they concern confidential information;

h.

it is the information and advice centre for enquiries about:

1.: procedures and the status of notification procedures and authorisation applications,
2.: forms, guidelines and foreign standards as well as contact addresses within the Federal Administration,
3.: the list of classified organisms;

i.

it may run courses and training sessions in its capacity as an information and advice centre;

j.

it receives information and reports from the cantons on their supervisory activities under Article 23, forwards them immediately to the responsible federal offices and issues an annual report on supervisory activities under this Ordinance.
