Art. 162 Radondatenbank

¹ Das BAG führt eine zentrale Radondatenbank. Es speichert darin die Daten, die notwendig sind, um den Vollzug der Messungen und der Sanierungen laufend beurteilen zu können und um statistische und wissenschaftliche Erkenntnisse zu gewinnen.

² In der zentralen Radondatenbank werden zu einzelnen Gebäuden folgende Daten gespeichert:

a.: Standort (Koordinaten, Parzellennummer);
b.: eidgenössischer Gebäudeidentifikator (EGID) und Wohnungsidentifikator (EWID) nach der Verordnung vom 31. Mai 2000⁵⁵ über das eidgenössische Gebäude- und Wohnungsregister;
c.: Raumangaben;
d.: Messdaten;
e.: Sanierungsdaten;
f.: Eigentümerin oder Eigentümer und Benutzerin oder Benutzer (Name, Adresse, Postleitzahl, Ort);
g.: Jahr der Errichtung.

³ Die Mitarbeiterinnen und Mitarbeiter der Fach- und Informationsstelle Radon des BAG sind berechtigt, die Daten in der Datenbank zu bearbeiten.

⁴ Zur Erfüllung der ihnen übertragenen Aufgaben haben die folgenden Stellen elektronisch Zugriff auf die nachstehenden Daten der Datenbank:

a.: die anerkannten Radonmessstellen: auf die eigenen gesammelten Daten;
b.: die Kantone: auf alle auf ihrem Gebiet erhobenen Daten;
c.: die Suva: auf alle an Arbeitsplätzen erhobenen Daten.

⁵ Das BAG kann Dritten gestützt auf eine Datenschutzvereinbarung Daten aus der Radondatenbank für Forschungszwecke unter den folgenden Auflagen und Bedingungen zur Verfügung stellen:

a.: Die Daten werden anonymisiert, sobald es der Zweck desBearbeitens erlaubt.
b.: Die Daten werden nicht weitergegeben.
c.: Werden die Ergebnisse veröffentlicht, so geschieht dies in vollständig anonymisierter Form.

Art. 162 Radon database

¹ The FOPH shall maintain a central radon database. In this database, it shall store the data which is required to allow continuous assessment of the implementation of measurements and remediation projects and to draw statistical and scientific conclusions.

² The following data on individual buildings shall be stored in the central radon database:

a.: location (coordinates, plot number);
b.: Swiss federal building identifier (EGID) and dwelling identifier (EWID) in accordance with the Ordinance of 31 May 2000⁵⁵ on the Federal Register of Buildings and Dwellings;
c.: information on the premises;
d.: measurement data;
e.: remediation data;
f.: owner and user (name, address, postcode, place);
g.: year of construction.

³ The staff of the FOPH Radon Technical and Information Centre are entitled to process the data in the database.

⁴ To fulfil the responsibilities assigned to them, the following shall have electronic access to data in the database as specified below:

a.: the approved radon measurement providers: to the data which they have collected themselves;
b.: the cantons: to all data collected on their territory;
c.: Suva: to all data collected at workplaces.

⁵ The FOPH may, on the basis of a data protection agreement, make available to third parties data from the radon database for research purposes subject to the following requirements and conditions:

a.: The data shall be anonymised as soon as the purpose of processing permits.
b.: The data shall not be transferred.
c.: If the results are published, this must be done in a completely anonymised form.
