Art. 15 Typenbewilligung für Strahlungsquellen

1 Das BAG kann für Strahlungsquellen mit besonders kleinem Gefährdungspotenzial für Mensch und Umwelt eine Typenbewilligung erteilen (Art. 29 Bst. c StSG), namentlich wenn:

a.
durch die Konstruktion oder durch Massnahmen verhindert wird, dass Personen unzulässig strahlenexponiert oder kontaminiert werden; und
b.
die Ablieferung an die Sammelstelle des Bundes als radioaktiver Abfall nach Ende der Gebrauchsdauer, sofern eine solche notwendig ist, gewährleistet ist.

2 Das BAG prüft die eingereichten Gesuchsunterlagen auf Vollständigkeit, Form, Inhalt und Umfang.

3 Es unterzieht die für die Typenbewilligung vorgesehenen Strahlungsquellen einer Typenprüfung. Es kann dafür andere Stellen beiziehen.

4 Es legt bei der Erteilung einer Typenbewilligung fest:

a.
unter welchen Bedingungen mit dem radioaktiven Material umgegangen werden darf;
b.
ob und wie radioaktives Material nach dem Ende der Gebrauchsdauer als radioaktiver Abfall an die Sammelstelle des Bundes abgeliefert werden muss;
c.
ob und wie die Strahlungsquellen mit einem vom BAG bestimmten Zeichen gekennzeichnet werden müssen.

Art. 15 Type licence for radiation sources

1 In the case of radiation sources with a particularly low hazard potential for people and the environment, the FOPH may grant a type licence (Art. 29 let. c RPA), in particular if:

a.
they are designed or measures are taken so as to prevent inadmissible exposure or contamination of persons; and
b.
it is assured that, if necessary, they will be delivered to the federal collection centre as radioactive waste at the end of their useful life.

2 The FOPH shall review the application documents submitted for completeness, form, content and extent.

3 It shall subject the radiation sources for which a type licence is sought to type testing. It may engage other bodies for this purpose.

4 When granting a type licence, it shall specify:

a.
under what conditions the radioactive material may be handled;
b.
whether and how radioactive material at the end of its useful life must be delivered to the federal collection centre as radioactive waste;
c.
whether and how the radiation sources must be marked with a symbol specified by the FOPH.
