Art. 67d Zusammenschlüsse autonomer Dienststellen von Gemeinwesen

(Art. 70 RTVG)

1 Als Unternehmen im Sinne von Artikel 70 Absatz 2 RTVG gilt auch der Zusammenschluss mehrwertsteuerpflichtiger autonomer Dienststellen eines Gemeinwesens.

2 Für die Zusammenschlüsse gelten Artikel 12 Absätze 1 und 2 MWSTG87 sowie Artikel 12 Absatz 1 MWSTV88. Artikel 67c Absätze 2, 4 und 5 sind sinngemäss anwendbar.

3 Die Abgabepflicht obliegt dem Gemeinwesen, welchem die zusammengeschlossenen Dienststellen angehören.

Art. 67d Combinations of autonomous agencies of public authorities

(Art. 70 RTVA)

1 A combination of autonomous agencies of a public authority that is liable to VAT also constitutes an undertaking in terms of Article 70 paragraph 2 RTVA.

2 These combinations are governed by Article 12 paragraphs 1 and 2 VATA87 and Article 12 paragraph 1 VATO88. Article 67c paragraphs 2, 4 and 5 apply mutatis mutandis.

3 The obligation to pay is that of the public authority to which the combined units belong.
