Art. 6a Sperrung des Zugangs zu Fernmeldediensten

Die Anbieterinnen von Fernmeldediensten müssen den Zugang zu Telefonie und Internet für Personen sperren, welche die Kundenbeziehung nicht über ein Abonnementsverhältnis aufgenommen haben, wenn diese Personen bei der Aufnahme der Kundenbeziehung:

a.
die Identität einer Person verwendet haben, die nicht existiert oder die der Aufnahme der Kundenbeziehung nicht vorgängig zugestimmt hat; oder
b.
kein Dokument vorgelegt haben, das die vom Bundesrat nach Artikel 23 Absatz 1 des Bundesgesetzes vom 18. März 201623 betreffend die Überwachung des Post- und Fernmeldeverkehrs aufgestellten Anforderungen erfüllt.

Art. 6a Blocking access to telecommunications services

Providers of telecommunications services must block the access to telephone and internet services for persons who have established a customer relationship that is not based on a subscription where these persons on establishing the customer relationship:

a.
have used the identity of a person who does not exist or who has not previously consented to establishing the customer relationship; or
b.
has failed to provide a document that meets the requirements imposed by the Federal Council under Article 23 paragraph 1 of the Federal Act of 18 March 201623 on the Surveillance of Postal and Telecommunications Traffic.
