Art. 59 Auskunftspflicht

1 Die diesem Gesetz unterstellten Personen sind verpflichtet, der zuständigen Behörde die Auskünfte zu erteilen, die für den Vollzug und die Evaluation notwendig sind.181

2 Sie haben dem BAKOM regelmässig die zur Erstellung einer amtlichen Fernmeldestatistik erforderlichen Angaben einzureichen.182

2bis Zu statistischen Zwecken gesammelte oder eingereichte Daten dürfen nur zu anderen Zwecken genutzt werden, wenn:

a.
ein Bundesgesetz dies ausdrücklich erlaubt;
b.
die betroffene Person schriftlich zustimmt;
c.
dies der Evaluation des Fernmelderechts dient; oder
d.
dies als Grundlage für notwendige regulierende Entscheide dient.183

2ter Das BAKOM kann die Marktanteile veröffentlichen.184

3 Der Bundesrat regelt die Einzelheiten.

Art. 59 Obligation to disclose information

1 The persons subject to this Act shall be obliged to provide the competent authority with the information required to implement and evaluate this Act.181

2 They must provide OFCOM regularly with the necessary information to produce official telecommunications statistics.182

2bis Data collected or submitted for statistical purposes may be used for other purposes only if:

a.
a federal act explicitly allows this;
b.
the person concerned consents in writing;
c.
this serves the evaluation of telecommunications legislation; or
d.
this serves as a basis for necessary regulatory decisions.183

2ter OFCOM may publish market shares.184

3 The Federal Council shall regulate the details.
