Art. 52 Übertretungen

¹ Mit Busse bis zu 100 000 Franken wird bestraft, wer:¹⁷⁰

a.¹⁷¹

das Frequenzspektrum benutzt:

1.: ohne die erforderliche Konzession,
2.: ohne die erforderliche vorgängige Meldung,
3.: ohne Inhaberin oder Inhaber des erforderlichen Fähigkeitszeugnisses zu sein, oder
4.: im Widerspruch zu den Nutzungsvorschriften oder zur Konzession;

Adressierungselemente, die auf nationaler Ebene verwaltet werden, in Betrieb nimmt, ohne dazu berechtigt zu sein;

d.¹⁷⁴

Fernmeldeanlagen, die den Vorschriften nicht entsprechen, importiert, anbietet, auf dem Markt bereitstellt oder in Betrieb nimmt;

e.

Fernmeldeanlagen, die den Vorschriften nicht entsprechen, erstellt oder betreibt;

f.

Fernmeldeanlagen an unbefugte Personen abgibt;

g.¹⁷⁵

Fernmeldeanlagen oder andere Vorrichtungen, die dazu bestimmt sind, den Fernmeldeverkehr oder den Rundfunk zu stören oder zu verhindern, herstellt, importiert, anbietet, auf dem Markt bereitstellt, besitzt, in Betrieb nimmt, erstellt oder betreibt.

² Wird die Tat fahrlässig begangen, so ist die Strafe Busse bis zu 50 000 Franken.

Art. 52 Contraventions

¹ Any person who:

a.¹⁷⁰

b.¹⁷¹

uses the frequency spectrum:

1.: without the required licence,
2.: without the required advance notice,
3.: without holding the required proficiency certificate, or
4.: in breach of the regulations on use or the licence;

c.¹⁷²

puts addressing resources that are managed at national level into service without being entitled to do so;

d.¹⁷³

imports, offers, makes available on the market or puts into service telecommunications installations that do not comply with the regulations in force;

e.

installs or operates telecommunications installations that do not comply with the regulations in force;

f.

hands over telecommunications installations to unauthorised persons;

g.¹⁷⁴

manufactures, imports, offers, makes available on the market, possesses, puts into service, installs or operates telecommunications installations or other devices that are intended to interfere with or prevent telecommunications or broadcasting

shall be liable to a fine not exceeding CHF 100,000.¹⁷⁵
